Mr. Welch (for himself, Mr. Merkley, and Mr. Sanders) introduced the following bill; which was read twice and referred to the Committee on Energy and Natural Resources


A BILL

To amend the Inflation Reduction Act of 2022 to repeal restrictions on onshore wind and solar.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short title.

This Act may be cited as the “Comprehensive Legislation for Expanding and Advancing Nonrestrictive Energy Act” or the “CLEAN Energy Act”.

SEC. 2. Repeal of onshore wind and solar leasing restrictions.

(a) Limitation on issuance of certain leases or rights-of-Way.—Section 50265(b) of Public Law 117–169 (commonly known as the “Inflation Reduction Act of 2022”) (43 U.S.C. 3006(b)) is amended—

(1) by striking “this Act” in the matter preceding paragraph (1) and all that follows through “the Secretary may” in paragraph (2) in the matter preceding subparagraph (A) and inserting “this Act, the Secretary may”; and

(2) by redesignating subparagraphs (A) and (B) as paragraphs (1) and (2), respectively, and indenting appropriately.

(b) Conforming amendments.—Section 50265 of Public Law 117–169 (commonly known as the “Inflation Reduction Act of 2022”) (43 U.S.C. 3006) is amended—

(1) by striking subsection (a) and inserting the following:

“(a) Definition of offshore lease sale.—In this section, the term ‘offshore lease sale’ means an oil and gas lease sale—

“(1) that is held by the Secretary in accordance with the Outer Continental Shelf Lands Act (43 U.S.C. 1331 et seq.); and

“(2) that, if any acceptable bids have been received for any tract offered in the lease sale, results in the issuance of a lease.”; and

(2) in subsection (c), by striking “paragraphs (1) and (2) of”.
