Mr. Huffman (for himself, Mr. Mullin, Mr. Garamendi, Mr. DeSaulnier, Ms. Eshoo, Ms. Lee of California, Mr. Panetta, Mr. Khanna, and Mr. Thompson of California) introduced the following bill; which was referred to the Committee on Transportation and Infrastructure


A BILL

To amend the Federal Water Pollution Control Act with respect to San Francisco Bay restoration, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. San Francisco Bay Restoration Program.

Section 125 of the Federal Water Pollution Control Act (33 U.S.C. 1276a) is amended—

(1) in the section heading, by striking “grant”; and

(2) by amending subsection (e) to read as follows:

“(e) Funding program.—

“(1) IN GENERAL.—The Director may provide funding through cooperative agreements, grants, interagency agreements, contracts, or other funding mechanisms to Federal, State, and local agencies, special districts, public or nonprofit agencies, and other public or private entities, institutions, and organizations, including the Estuary Partnership, for projects, activities, and studies identified on the annual priority list compiled under subsection (c).

“(2) MAXIMUM AMOUNT OF FUNDING.—

“(A) GRANTS.—

“(i) MAXIMUM AMOUNT.—Amounts provided in the form of a grant to any entity under this section for a fiscal year shall not exceed an amount equal to 75 percent of the total cost of any projects, activities, and studies that are to be carried out using those amounts.

“(ii) NON-FEDERAL SHARE.—Not less than 25 percent of the cost of any project, activity, or study carried out using amounts provided in the form of a grant under this section shall be provided from non-Federal sources.

“(B) INTERAGENCY AGREEMENTS AND CONTRACTS.—Amounts provided to entities under interagency agreements, contracts, or other funding mechanisms under this section may cover up to 100 percent of the total cost of any projects, activities, and studies that are to be carried out using those amounts.”.
