A BILL

To amend title 18, United States Code, to improve the Federal carjacking statute.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short title.

This Act may be cited as the “Federal Carjacking Enforcement Act”.

SEC. 2. Motor vehicles.

Section 2119 of title 18, United States Code, is amended—

(1) in the matter preceding paragraph (1), by striking “, with the intent to cause death or serious bodily harm” and inserting “knowingly”; and

(2) in paragraph (3), by striking “if death results,” and inserting “if the motor vehicle is taken with the intent to cause death or serious bodily harm, and death results,”.

SECTION 1. Short title.

This Act may be cited as the “Federal Carjacking Enforcement Act”.

SEC. 2. Motor vehicles.

Section 2119 of title 18, United States Code, is amended—

(1) in the matter preceding paragraph (1), by striking “, with the intent to cause death or serious bodily harm” and inserting “knowingly”;

(2) in paragraph (1), by striking “both,” and inserting “both;”;

(3) by striking paragraph (2) and inserting the following:

“(2) be fined under this title or imprisoned not more than 25 years, or both, if—

“(A) (i) the motor vehicle is taken with the intent to cause death or serious bodily harm; or

“(ii) the person taking the motor vehicle brandishes or discharges a firearm (as defined in section 921) during or in relation to such taking; and

“(B) serious bodily injury (as defined in section 1365, including any conduct that, if the conduct occurred in the special maritime and territorial jurisdiction of the United States, would violate section 2241 or 2242) results; and”; and

(4) in paragraph (3), by striking “if death results,” and inserting “if the motor vehicle is taken with the intent to cause death or serious bodily harm, and death results,”.
