Mr. Langworthy (for himself, Mrs. Harshbarger, Mr. Balderson, Mr. Rulli, Mrs. Fedorchak, Mr. Harrigan, and Mr. Goldman of Texas) introduced the following bill; which was referred to the Committee on Energy and Commerce, and in addition to the Committee on Transportation and Infrastructure, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned


A BILL

To amend the Energy Conservation and Production Act to repeal certain Federal building energy efficiency performance standards, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short title.

This Act may be cited as the “Reliable Federal infrastructure Act”.

SEC. 2. Repeal of revised Federal building energy efficiency performance standards.

(a) In general.—

(1) REPEAL.—Section 305(a)(3) of the Energy Conservation and Production Act (42 U.S.C. 6834(a)(3)) is amended by striking subparagraph (D).

(2) STANDARDS.—Each revised Federal building energy efficiency performance standard established under section 305(a)(3)(D) of the Energy Conservation and Production Act (42 U.S.C. 6834(a)(3)(D)) (as in effect on the day before the date of enactment of this Act) shall have no force or effect, and section 305(a)(3) of the Energy Conservation and Production Act (42 U.S.C. 6834(a)(3)) shall be implemented as though each such standard had never taken effect.

(b) Conforming amendments.—

(1) STANDARDS.—Section 433 of the Energy Independence and Security Act of 2007 (Public Law 110–140) is amended by striking subsection (a).

(2) HIGH-PERFORMANCE GREEN FEDERAL BUILDINGS.—Section 436 of the Energy Independence and Security Act of 2007 (42 U.S.C. 17092) is amended—

(A) in subsection (c)—

(i) by striking paragraph (1); and

(ii) in paragraph (6), by striking “and section 305(a)(3)(D) of the Energy Conservation and Production Act (42 U.S.C. 6834(a)(3)(D))”;

(B) in subsection (e), by striking “in accordance with the requirements of section 305(a)(3)(D) of the Energy Conservation and Production Act (42 U.S.C. 6834(a)(3)(D)),”;

(C) in subsection (f)—

(i) in paragraph (1)—

(I) in the matter preceding subparagraph (A), by striking “, the requirements of section 305(a)(3)(D) of the Energy Conservation and Production Act (42 U.S.C. 6834(a)(3)(D)),”; and

(II) in subparagraph (A), by striking “and the requirements of section 305(a)(3)(D) of that Act”; and

(ii) by striking paragraph (2); and

(D) by striking subsection (h).

(3) FEDERAL GREEN BUILDING PERFORMANCE.—Section 437(a)(1) of the Energy Independence and Security Act of 2007 (42 U.S.C. 17093(a)(1)) is amended by striking “, section 305(a)(3)(D) of the Energy Conservation and Production Act (42 U.S.C. 6834(a)(3)(D)),”.
